The Act on the Prohibition of Discrimination against Persons with Disabilities and Remedy against Infringement of Their Rights
Article 14 (Gradual Scope of Legitimate Convenience Provision and Content of Convenience in Information and Communication) A website that ensures accessibility, enabling individuals to access desired services through the website, irrespective of physical or technological conditions.
Mandating Web Accessibility Compliance
Since April 11, 2008, compliance with web accessibility for both public and private websites has been mandated under Article 21 of the Act on the Prohibition of Discrimination against Persons with Disabilities and Remedy against Infringement of Their Rights(hereinafter referred to as the "Disability Discrimination Act") and Article 14 of its enforcement decree. Web accessibility compliance has been gradually enforced to prevent discrimination against individuals who are unable to access and utilize websites due to disabilities.
Procedure for Remedy under the Disability Discrimination Act
In cases where individuals with disabilities face discrimination or non-compliance with obligations:
- ① Submission of a petition by individuals with disabilities or related parties.
- ② Investigation by the National Human Rights Commission, issuance of a corrective recommendation, non-compliance leading to the Ministry of Justice issuing a corrective order, and failure to comply resulting in fines.
- ③ Civil lawsuit for damages in court.
- ④ Initiation of criminal proceedings by judicial authorities.
- Non-compliance with corrective orders may result in fines of up to 30 million KRW (Aricle 50 of the Disability Discrimination Act).
- If discriminatory acts are malicious (considering intent, persistence/repetition, retaliation, etc.), imprisonment for up to three years or fines of up to 30 million KRW may be imposed (Article 49 of the Disability Discrimination Act).
